In the ongoing saga between Apple and Samsung where Samsung was penalised a $1.05 Billion fine, which is one amongst the many patent infringement battles across the globe, Apple made a statement yesterday that there might be a possible error committed by Judge Koh in awarding $450 million off of the initial penalty against Samsung and that Apple will have to be awarded $85 million back again. Last month Judge Koh ruled out 14 of Samsung devices to be reevaluated against the patent infringement and the $450 million associated to those 14 devices will be put on hold for now. Out of those 14 devices Apple says that two of Samsung’s devices Samsung’s Galaxy S II AT&T and Infuse 4G were sold well in the permissible period and Judge Koh should reevaluate the judgement.
If Apple’s claims were to turn out to be true then Samsung will have to shell out an approximate amount of $685 million to Apple for infringing various patents. The current hearing is scheduled for May of 2013 but FOSS patents suggests that the hearing might be further delayed due to the new developments. One major complication in Apple’s claim is to evaluate the exact period of launch and the period of sale of these devices which will prove to be tricky for the final verdict.
Meanwhile, Samsung has been trying to push the case further favouring itself by requesting Judge Koh to finalise the decision for the 14 products that are under reconsideration right now.
